GENERAL TERMS
In the terms and conditions set out in this document, the following terms shall, unless contrary to the context, mean parties in contract for the specific booking, “You/Your/ Passenger the person(s) in whose names and/or on whose behalf the Booking is made” and “We/Us/Company/Our Company means “NTP TOURISM AFFAIRS LIMITED” referred as NTP.
NTP the Company is a travel, tourism, treks and pilgrimages, variety of amusements, events helicopters, cruise organizers, NTP is seller and the consolidators of the said components but do not own, operate or control any component e.g.: Airlines, Shipping Company, Coach Company, Hotel, Transport Company, Restaurants or any other allied services provided in the itinerary at the management and during the course of the tour execution.
These General Terms are to be read along with the itinerary specific terms handed over to you along with itinerary/handout and shall form the part of contract between you and the company.
All communications regarding tour and travel service bookings will be directed to https://www.ntpgroups.com/, that is NTP Tourism Affairs Limited.
Payments: For all the booked services, guests have to pay a certain advance payment to hold and confirm the booking. The balance amount should be paid before the departure from your country or upon arrival in India as per package plan and policy (check with the docket charge), but it should be always before the set pattern of payment contracted, dues resolved, NTP has the right to refuse any service or all the services if the terms in the contract is breached. The Management has the right to forfeit the advance amount received in case contracted dues are not cleared in the timeline for the obvious reasons NTP holds its commitments with the NTP vendor contracts and to pay, clear the dues in schedule.
Often the entire sum is realized from the clients/ guests to book any services e.g. for the Airlines, trains, for resort or hotel bookings and special train journeys, guests have to pay the full amount to confirm the booking.
Mandatory Identification Document:
It is Mandatory for all guests (Foreign Nationals, NRI’s and Indian Nationals) to provide Photo ID at the time of booking confirmation. Documents as per details given below are applicable for different categories:
- For foreign nationals – a copy of Passport + Visa is mandatory.
- For Non-Resident Indians clients (NRI clients) – copy of passport.
- For Overseas Indian clients holding OCI / PIO card – copy of passport and copy of OCI/PIO card is mandatory.
- For domestic clients – copy of Driving License / Voter ID Card / passport is mandatory.
Mode of Payment: PAYMENT TERMS
- Please note that all services rendered and facilitated by the company are subject to full realization of payment by you as per the contract which cant be facilitated prior to the date of departure or on the verge of the itinerary commencement. IN CASE the payment for the services availed by you is made by cheque the package shall only be delivered to you after the realization of the cheque.
- Note : Please note that company in its complete discretion shall refuse to accept the cheque if there are less than five working days available (from the date of presentation of the cheque by you) till the date of our contract to clear the dues, in no case dues are chased until the day of your departure.
Cancellation Policy
In case of cancellation of tours or any other travel services due to any reason, you are requested to write to us about it. We will proceed with the cancellation charges from the day we receive the letter in writing and the cancellation charges will be in the following manners:

Cancellation charges for the transport tickets will be applicable based on the concerned authority. Flight tickets bought on special fares are non-refundable and the guests have to bear the entire cancellation charges.
CANCELLATION POLICY
Cancellation policy would adhere to Contractual terms at the time of the booking, further to expand for the understanding that -
- Company reserves its right to cancel the booking being made by you or even amend the same, if necessary, without assigning any reasons thereof, Such amendment or cancellation may be due to circumstances beyond the control of the company. As per the policy of the company, the company in its best endeavours shall book alternate Hotels for you, after confirming the dates with you. However, at no point of time shall our Company shall be responsible or liable to pay any compensation or damage or any other expense or business loss suffered by you due to the cancellation or amendment of the tour package booked by you.
CAUTIONS TO CARE FOR THE CANCELLATION OF BOOKING OPTED BY YOU THE BOOKING PARTY / PERSON
- In case you wish to cancel the tour package booked, you must notify us in writing through email. Only after the receipt of the same by our company staff, it shall be deemed that the said communication has been received by our company.
- The cancellation charges shall apply, irrespective of the reason for cancellation whatsoever, including medical emergency or pregnancy. You understand and acknowledge that these charges are genuine and are the pre-estimate of the damages that our Company will suffer on account of cancellation being made by you. Further in group bookings, if the cancellations are being made due to any reasons, it shall increase the cost of the entire group which cost cannot be burdened upon other group members traveling, so the cancellation charges are on higher side in order to mitigate that loss which the company has to bear on account of you not traveling. However, our company in its best endeavour tries to mitigate the loss as minimum as possible on you in terms of the cancellation policy. You further univocally understand that the said cancellation charges shall be paid by you without any dispute and the same are explained to you at the time of finalization of the itinerary. If the tour is 100% confirmed and delivered there shall be 100% Cancellation charges.
CAUTIONS TO CARE FOR THE CANCELLATION DUE TO REFUSAL OF VISA BY THE EMBASSY
Granting and rejection of VISAS is the sole discretion of the embassy. Our Company only acts as a facilitator for obtaining the VISA. The company shall, under no circumstances, be held liable or responsible for rejection of VISAS and any other related incidental or consequential loss, damage, cost or expense. You are required to submit a copy of the VISA granted to you.
- If the rejection of VISA is intimated by the embassy within the cancellation period specified above, then the cancellation charges as appearing shall be applicable. You are required to submit a Refusal of VISA to us. For the purpose of ascertaining the applicable cancellation rates, the cancellation under this head will be deemed to have been made only when we receive the intimation of VISA rejection from the embassy. Subsequently, if you choose to re-apply for the VISA, then in that case the cancellation charges, if any, shall be borne by you from the date of second refusal, if any. If in case we have received no intimation from the embassy of accepting a VISA application before the departure date of the tour, then in that case the maximum cancellation charges shall apply.
CAUTIONS TO CARE FOR THE CANCELLATION FOR WANT OF BALANCE PAYMENT
- The tour package booked by you, can be cancelled for want of balance payment of the tour package, wherein after subsequent request you have failed to deposit the balance payment In such a case we reserve the rights to cancel the tour package and shall recover the balance amount, if any, from you after adjusting the advance received.
- Please note that after applying the cancellation policy, if there is any amount which is to be refunded it shall be remitted only by way of a cheque which shall be drawn in the name of the person whose name the booking is made. Company shall not take any request of remittance of the amount to any third party or of remittance in form of cash as the same is against the company policy.
CAUTIONS TO CARE FOR THE PROCESSING CHARGES
- We hold our right to charge a processing fee which shall be 8% of package cost, if booking is withdrawn by you even 5 minutes after confirmation of booking reference number being communicated to you from our end. Once confirmation is conveyed normal cancellation charges shall be applied.
TOUR CONDITIONS
- You will have to strictly follow the tour program and comply with the terms and conditions of the various contractors/ third party vendors such as Hotels, Airlines, Destination Management Companies, Cruise, and Insurance etc.
- You are further requested to be punctual and adhere to the time-lines of the tour. In case of you not being punctual you may miss your flight, your coach and your meal etc for which you cannot claim any damage from our company.
- You understand that you are traveling in the group, and you shall not behave in a manner which causes distress or annoyance to other tour participants. In case you behave in a manner which is rowdy and indecent, you may be asked to leave the group at your cost and peril.
- It is understood that there shall be no refund or compensation whatsoever for unutilized services whether as a matter of choice or caused by your fault or compelled by circumstances such as ill-health, weather or any other reason.
TOUR COST INCLUDES AND EXCLUDES
- All services provided to you shall be as per those specified/confirmed and paid by you as detailed in the itinerary and travel voucher being handed over to you. Example, if you avail any service such as porterage, room service, laundry, charge, a-la- carte meals, alcoholic beverages, bottled water, soft drinks, paid toilets etc or anything that is not specifically shown as included in the Tour Cost, then the payment for the same will have to be made by you.
Individual Tours (FIT Tours)
Individual tour cancellations will be subject to changes. It will depend on the cancellation policy of the booked hotels and other service operators linked with the tours. Due to the different cancellation policies of different service operators and hotels, we have to abide by them.
If in any unfortunate case a guest cancels a trip, we would charge 20% of the total amount as a processing fee with the charges levied by the service providers.
Important Note: For bookings made in the high peak season, if a cancellation is made due to any reason, there will be no refund for the cancelled booking.
Journey booked for special trains like Indian Maharaja & Maharajas Express, Golden Chariot, Deccan Odyssey, Royal Rajasthan on Wheels, and Palace on Wheels. A separate cancellation policy will be applicable.
During peak season, which means the density of tourists in each destination, the hotels booked have different cancellation policies. NTP is bound to abide by the specific cancellation rules of different hotels. The extra payment in cancellation charges has to be paid by the client and not the travel agent.
In case of trip cancellation, after the journey starts, a refund will be in a limited amount and would depend on the cancellation policies of our patron hotels. For missed meals, chartered transportation, unused hotel accommodation, etc. We do not take any guarantee of refund.
If any guest sends the cancellation, or modification requests to the hotel directly, it will not be honoured.
In the case of unutilized services, the refunds will be based on the cancellation policy mentioned above. If payment is received through a credit card, upon cancellation, the refund will be made through the same credit card. Please note that the process of refund may take 2 to 8 weeks due to the procedures of the bank.
There will be no deductions in the refunds if the cancellations are made due to the unavailability of the services. If the services are unavailable during the requested time, we will offer similar options before the commencement of the tours and services, and if the client finds the alternatives unacceptable, they will get a refund of the advance. However, if the guest accepts the service, and wants to cancel it later, it will be subject to the same cancellation policies stated above.
COACHES FOR TRANSPORTATION INTERNALLY WITHIN THE CITY
- In our best endeavours our company engages in only air-conditioned coaches for transfers within the city and from city to airport and vice-versa. However, Our Company takes no responsibility for break-down of the same due to any reason. The coaches provided by the Destination Management Company (DMC) are generally 7to 10 years old.
- Also be informed that in group tours seat numbers are allocated on rotation basis. In countries such as Europe & USA the maximum traveling time by coach is 8 to 10 hours or more in a day under normal road and traffic conditions. If you or any of your co-passengers miss any service due to unpunctuality, our Company shall not be liable to refund any amount. Neither shall we be liable to refund any amount or pay any compensation/damages for any change in itinerary nor for missing any service due to the unpunctuality or actions of your co-passengers for any delays due to any reasons. The transfers being provided are generally Seat in Coach (SIC) on a sharing basis. In case of sharing transfers, one may have to wait for a longer duration, in case of coach transfer from airport to hotel as all the passengers need to clear the immigration check and assemble at the airport meeting point.
- You are advised to cooperate with the tour coordinator working on behalf of the Destination Management Company (DMC) to enable him hassle free coordination.
HOTEL
- Company reserves the right to change the Hotels being suggested in the itinerary as the same are always indicative to the category of the Hotels the company shall be providing, not that the company is bound to provide the Hotels mentioned in the itinerary. Company shall provide a Hotel with a similar category at all times.
- Company selects Hotels for your stay at locations, as provided by its Destination Management Company (DMC) for various reasons, in countries such as Europe and USA the hotels chosen are away from the city centre as they are comparatively cheaper in comparison to the Hotels situated in the downtown or main city centre area, which at times leads to long drives between the Hotel and the main city. At the time of check-in of the Hotel we request you to follow instructions of the coordinator and hotel staff. It may take some time for them to give you room due to peak season and heavy footfall, you have to cooperate and wait until room is allocated. At times there may not be an air conditioner or fan due to climatic conditions.
- The standard check in time for Hotels across the globe is 14:00 Hrs onwards and the check out time is 12:00 Hrs latest or before that. Hotels may not provide you breakfast on the day of check-in unless and until you have requested for an early check-in for which you have to pay additional charges.
- Hotel may ask for a security deposit, any damage in the hotel, the cost of it will be adjusted while refunding the security deposit by the hotel. Adjacent, interconnecting, king bed size, no smoke cabins may be provided, if available with the Hotel. Hotel management may charge for these requests.
- It is further understood that the actual distance of each Hotel from the city center is known and is already disclosed to you with the help of the hotel website by our staff.
- The company shall arrange alternate accommodation in a “similar type” or “similar category” Hotel. Notwithstanding, anything similar herein means similar Hotel accommodation costing almost similar rates. It does not here mean or imply that the location of a similar Hotel shall be in the same vicinity of the Hotel tentatively mentioned.
- Notwithstanding the above, if in case in the process of changing the hotel, we shall try to provide you the best possible hotel of a “like” or “similar category” or at times shall even upgrade your hotel. In case, despite our best efforts there is degradation of the Hotel, in comparison to one which was earlier booked, the differential amount shall be returned to you. It will be calculated by comparing on-line rates of both properties as on a particular date. The liability of the company in such a case shall be limited only to the differential amount, if any. However, for any increased tariff paid, the Company shall shoulder the additional burden as a goodwill gesture.
- Also note, most of the Hotels worldwide and also the Cruise vendors may request you to give a security deposit at the time of check-in which can be either in the form of local currency or by way of charging the credit card, which is refundable/ returnable at the time of check out, after adjusting the dues, if any. It is implicit that the security amount to be deposited at the time of check in of the Hotel is not included in the package cost for which you have to make your own arrangements. It is further informed that in case you wish to enquire the exact security amount to be deposited, we would request you to check hotel website or speak directly with the concerned hotel
- Our Company shall not be held liable for the room conditions or any of its amenities. If there is any issue with any of the amenities in the Hotel rooms with respect to Wi-Fi, Air Conditioning, Security or any other such facilities, the same shall be brought to the knowledge of the Hotel management, who shall in its best effort and endeavor try to resolve the problem, if any.
COMPANY RESERVES THE RIGHT TO CHANGE THE ITINERARY WITHOUT ANY PRIOR NOTICE TO YOU
- We reserve the right to alter, amend, change or modify the tour package and itineraries before or during the tour. We will make all reasonable efforts to notify you promptly of such changes/ events sufficiently in advance during booking or prior to departure of the tour, and we will solicit your full cooperation in accepting such circumstantial changes. Therefore, no grievance with respect to change in itinerary/ service change which we are constrained to make, will be entertained from you during or after the tour. Such changes may be necessitated due to factors beyond our control such as force majeure events, strikes, fairs, festival(s), sport event(s), weather condition(s), traffic problem(s), overbooking of hotel(s) flight(s), cancellation, re-routing of flight(s) or railway, closure of/ restricted entry at a place of sightseeing etc.
Unused Services are Non-Refundable
There will be no refund for unutilized services. This generally applies to all kinds of under-utilization and non-utilization of tour services. Whether the non-utilization was a matter of choice or caused by the fault of the guests or by circumstances like weather, sickness or external factors, there will be no refunds.
Furthermore, there will be no refund if you fail to utilize services in the tours such as meals, cruises, rides, sightseeing, hotels, flights, optional tours, etc due to any reason like ill-health, late reporting etc.
Important Note: Written cancellations from guests are accepted from Monday to Saturday. Any request for cancellation sent on Sunday will be considered for the next day, Monday, or on the next workday of any gazetted holiday from 12 pm to 5 pm.
For the new year and Christmas period from December 20 to January 5, all payments made will be non-refundable.
Specific Cautions for the Kailash & ManSarovar Tour Cancelation Policy -
This tour has separate guidelines for payment and cancellation. For the booking, guests have to pay INR 10,000 in advance for the India Kailash Darshan, and INR 20000 for the Tibet Kailash tour. Once the payment is made, this stands for the confirmation and it becomes a non-transferable and non-refundable amount of the tour.
In case of the cancellation of the Kailash package trip, after the commencement of the tour, there will be limited refund options.
Cancellation of Wildlife Safaris: All the safaris booked into any Indian Wildlife Sanctuaries or National Parks are non-refundable. Date change requests will also be considered as cancellations and there will be no refund.
Helicopter/charter, Tour Permits, Visa fees, and Bookings: Once booked, cancellation of any of these options are considered nonrefundable. Additionally, after the final booking, if there are any increases in entrance fees, guide fees, fuel costs or taxes by the Government of India, there will be extra charges for the same.
We provide sample itineraries that are for the purpose of giving a general overview of the tour and its schedule. There may be changes in the itineraries due to weather, the physical abilities of the guests, road conditions, statutory guidelines, natural and political reasons, pandemics, epidemics, etc. We have the full right to make any changes to ensure the safety of the participants and their well-being.
Our rates are based on the negotiated costs by us with the airlines, hotels, etc. In case of any changes in the rates quoted before the final booking, it can be altered by the airlines and hotels. All hotel bookings are based on the usual check-in and check-out times mentioned in the itinerary.
We will not be responsible for any alterations and delays in the programs or the extra costs incurred indirectly or directly due to political closure, landslides, sickness, weather, breakdown of transport, breakdown of machines, accidents, flight cancellations, natural calamities or any other unforeseen incidents.
We will also not be responsible for any property, damage to a person, injury, loss, indirectly or directly by the act of GOD, epidemics, strikes, riots, civil disturbances, wars, breakdown of transports, accidents, fire, dangers, anything caused that are beyond our control.
We do not offer any insurance policy that can cover the expenses incurred for the loss due to theft, sickness, accidents or any other reasons. Guests are requested to make such arrangements in their home country before arriving in India. All personal property and baggage are, at all times, the responsibilities of the guests.
Extra Usage of Vehicle:
Please note that the cost of extra usage of vehicle (cars / coaches with the driver) is not included in the services and hence extra usage of Vehicle after transfer or after sightseeing is not allowed.
Special Note for Helicopter Journeys :-
- Helicopter Tickets & Fare are subject to availability & can change at any moment.
- While Indian NTP Tourism Affairs Limited takes utmost care to make you fly by Helicopter but due to sudden weather conditions / VIP Movement / unavoidable situations at the last moment - it sometimes becomes unavailable. NTP will make every possible attempt to arrange for alternate Helicopter journey on the same day or on alternate dates depending upon the availability of Helicopter at that time.
- No ticket would be carried forward to the next day.
- No accommodation, meal or cost of transport would be paid or reimbursed or compensated due to cancellation of Helicopter.
- In case of Journey/ Yatra by Helicopter (Like Chardham Yatra/ Teen Dham Yatra/ Do Dham Yatra/ Ek Dham Yatra/ Vaishno Devi Yatra/ Amarnath Yatra) – a separate cancellation policy will be applicable and same would be advised on case to case basis.
Important Note: We will not be responsible for any cost incurred due to unforeseen incidents such as bad weather, roadblocks, landslides, etc.
INTERNATIONAL SIM CARD
- We, in order to facilitate our customer’s outbound travel, make available SIM cards for international use which is a third party product and is introduced directly by the seller company. Before buying the same from our company we request you to read the terms and conditions of the company as the same are the subject matter of solicitation. You are free to purchase any such article from the market. In case it is purchased by you through our company, we request you to make enquiries from the company directly and buy the same after being satisfied.
- Our Company shall not be held responsible or liable for any sort of defect in the product, in services, billing or any other complaint. For any such query you will have to directly write to the seller company.
LIABILITIES
- You are advised to read carefully all the terms and conditions in order to understand your duties, responsibilities and risk before signing the contract. Our company is a tour organizer and we shall not be held liable for any loss, injury or damage with respect of life, limb, property, sickness, discomfort, additional expenses incurred by you or for any direct, indirect, consequential loss or damage of any kind suffered by you however. In case our liability arises from this contract, it is understood that it shall not exceed the total amount paid for the tour by you. Further in no case or circumstances shall Our Company can be held personally liable for any indirect, special or consequential losses or damages whatsoever.
- Our company shall not be liable to you for refund, compensation, claim if the number of days is reduced, postponement or re-routing of any transport service due to any reason whatsoever. Our company is acting as a booking agent for the overseas tour operator/travel component supplier and at best can be described as a holiday organizer. Please note that the information being given on the website and the printed brochures is what company is being briefed about by the Destination Management Companies (DMCs), and if in case any information as being provided in the brochures or website of the company is not accurate, our company shall change the same as soon as it comes to the knowledge of the company. However, Our Company cannot be held liable for loss or damage being suffered due any such information. It is understood that Our Company does not control or operate any Airline, nor does it own any shipping company, coach or coach company or Hotel or Transport Services, and as such if any loss or damage is being caused due to such carriers or Hotel, Our Company cannot be held liable.
GOVERNING LAW & JURISDICTION
- This Agreement and any matter relating thereto shall be governed, construed and interpreted in accordance with the Laws of India. You agree that in the event of any dispute on difference between the parties the exclusive jurisdiction of the courts/tribunals shall be of New Delhi only.
Force Majeure:
NTP Tourism Affairs Ltd.. (company) and any of its parents, subsidiaries, affiliates, officers, directors, employees, agents or suppliers and their respective successors, heirs and permitted assigns shall not be responsible for, or be deemed to be in default on account of any failure to perform or due to delay in performance of any of its obligations hereunder, in whole or in part, if such performance is rendered impracticable by the occurrence of acts of war, whether declared or undeclared, sabotage, embargo, acts of terrorism, riot or other civil commotion, failure in transportation, act of any government or any court or administrative agency thereof, acts of God, fire, explosion, flood, earthquake, strike, act of government or other catastrophes, pandemic, epidemics, outbreak of disease or quarantine restrictions, or other cause(s) beyond the reasonable control of NTP Tourism Affairs Ltd. (“Force Majeure”).
NTP Tourism Affairs Ltd. (company) and client (you)– both shall use their best efforts to avoid, overcome and offset the effects of any cause or potential cause of an event of Force Majeure. Upon cessation of the cause of the Force Majeure, the Terms and conditions of use given hereunder, shall again become fully operative.
However, a Force Majeure event will not relieve NTP Tourism Affairs Ltd. (company) and client (you) of the obligations accrued prior to the occurrence of the Force Majeure.
Jurisdiction Clause :
All the disputes arising out of this agreement or any other subsequent agreement would be subject to Delhi Courts only.
Special Note:
- Terms & Conditions for Andaman & Nicobar island, Lakshadweep island will be separate and the same will be advised on a case to case basis.
- Terms & conditions for Group booking will be separate and the same will be advised on a case to case basis.
- Terms & conditions for Yatra by Helicopter (Chardham Yatra/ Teen Dham Yatra/ Do Dham Yatra/ Ek Dham Yatra/ Vaishno Devi Yatra/ Amarnath Yatra) and any other tour by Helicopter will be separate and same will be advised on case to case basis.
- Terms & conditions for Tourist/ Luxury Trains (Palace on Wheels/ Deccan Odyssey/ Maharajas Express/ Golden Chariot) and any other Tourist / Luxury trains will be separate and the same will be advised on a case to case basis.
NO LIABILITY OF THE COMPANY FOR THE SERVICES PROVIDED BY THE THIRD PARTY
- In the event, if any booking is being made by you for travel service, also including but not limited to the insurance policy, international SIM card which is controlled and operated through any third party operators like adventure sports etc. the terms and conditions of such third party operators, including their payment schedules, cancellation policies, refunds etc. shall be applicable to you in addition to these terms and conditions and we cannot be fastened with any kind of liability for the same.
